Supreme Court to Hear Habeas Corpus Petition of Oli and Lekhak

Kathmandu: The Supreme Court is scheduled to continue hearing today on a writ petition seeking the release of KP Sharma Oli and Ramesh Lekhak, who are currently in custody.

The hearing, which began on Sunday in the bench of Justices Binod Sharma and Sunil Kumar Pokharel, was postponed due to time constraints, according to court spokesperson Arjun Prasad Koirala.

The writ petition was filed on Chaitra 15 by Oli’s wife Radhika Shakya and Lekhak’s wife Yashoda Lekhak, claiming that their detention is unlawful. Earlier, on Chaitra 16, a separate bench comprising Justices Meghraj Pokharel and Kumar Regmi had issued a show cause order to the government.

The petition argues that the arrests were made solely based on the recommendations of an inquiry commission formed to investigate the incidents of Bhadra 23 and 24, which, according to the petitioners, is not legally sufficient grounds for detention. It further claims that arresting and holding individuals directly on the basis of a commission report is unlawful.

Today’s hearing is expected to provide greater clarity on whether the court will order their release or allow their continued detention.
